CARLISLE — Zoning Board of Appeals accepts withdrawal in basement-expansion case, receives legal guidance on bylaw conflict. Town Counsel Ethan Dively advised that Carlisle's Section 6.3, which caps residential expansion at 50 percent of existing floor area, likely conflicts with Massachusetts General Laws Chapter 40A, Section 6, which establishes minimum state protections for property owners that towns cannot make stricter. Dively recommended the town amend the bylaw, that the board exercise discretion to follow state guidelines pending amendment, and that planning staff coordinate with the building commissioner.
Members Eric Adams, Ian Applegate, and Kyle Rogers voted 3-0-0 to close the public hearing and accept the applicant's withdrawal without prejudice; W. Jay Lee and Emmanuel Crespo abstained.
